These Terms & Conditions (“Terms”) govern your use of the website davistreeservicepros.com and the tree care services provided by Davis Tree Service (“Davis Tree Service,” “we,” “us,” or “our”). By using our website or hiring us, you agree to these Terms. If you do not agree, please do not use the website or request our services.
Our Services
We provide residential and commercial tree care, including tree removal, tree cutting, tree trimming, crane service, stump grinding, stump removal, and emergency tree service. Our primary service area is Ponca City, Oklahoma, and surrounding communities in northern Oklahoma and southern Kansas, including Arkansas City, Blackwell, Newkirk, Wellington, Udall, and Winfield. Information on our website is for general purposes and does not create a contract for any specific job.
Estimates and Quotes
Estimates are free and come with no obligation.
Where possible, we inspect the property and provide a written estimate before work begins. The estimate describes the scope of work and price, including cutting, hauling, and cleanup unless stated otherwise.
Prices or price ranges shown on the website, including those in our FAQ, are general examples only. Your actual price depends on tree size, access, condition, hazards, equipment needed, and job complexity.
A written estimate is valid for the period stated on it. If none is stated, it is valid for 30 days. Work does not begin until you accept the estimate (in writing, by text or email, or by signing) and we confirm a date.
If conditions on site differ from what we saw when quoting, such as hidden decay, difficult access, extra trees, or buried objects, we may adjust the price. We will explain the change and get your approval before continuing.
Scheduling and Weather
Scheduled dates and arrival times are estimates. Weather, ground conditions, equipment issues, and emergency calls may delay work. If we must reschedule, we will contact you as soon as we can. We are not liable for delays caused by conditions outside our control.
Emergency Services
We offer emergency response 24 hours a day, 7 days a week. Emergency work may be priced differently from scheduled work because of the urgency, time of day, and conditions. We will give you the price or rate before starting whenever it is safe and practical to do so.
In an emergency involving injury, fire, or downed power lines, call 911 first and stay clear of the area. Never approach a tree or limb touching a power line. We check for power line contact before any saw starts, but only the utility company can make a line safe.
Crane Service and Heavy Equipment
Some jobs require a crane, bucket truck, skid steer, stump grinder, or other heavy equipment. This equipment is heavy and may leave ruts, tracks, or compaction on lawns, driveways, and other surfaces, particularly when the ground is soft or wet. We take reasonable steps to limit this, such as using mats or choosing travel routes where practical, but some surface marking can be unavoidable.
For crane jobs, you agree to provide a clear and reasonably level setup area and access route, and to tell us about anything underground or overhead along that route that could be affected by heavy equipment, including septic systems, drain lines, wells, utility lines, and low or sagging wires. Jobs may be postponed or the price adjusted if the site cannot safely support the equipment.
Customer Responsibilities
To help us work safely and accurately, you agree to:
- Confirm that you own the property or have the owner’s authority to approve the work.
- Point out the trees and stumps to be worked on and show property lines. We rely on your direction. If a tree belongs to a neighbor or sits on a boundary, you are responsible for any needed agreement with that neighbor.
- Tell us about hazards we may not see, including underground utilities, septic systems and lines, irrigation, invisible fences, wells, drain lines, and buried objects.
- Have the public underground utilities marked by calling 811 before any stump grinding or stump removal, or any other work that involves digging, where required by law.
- Give us clear access to the work area and move vehicles, furniture, and valuables out of the drop zone. Fragile items such as window boxes, decorations, or outdoor equipment near the work area are at your risk if not moved.
- Keep people and pets away from the work area.
- Obtain any permits, homeowners’ association approvals, or municipal approvals required for the work, unless we agree in writing to handle them.
Scope of Work, Cleanup, and Stumps
We perform only the work described in the accepted estimate. Additional work requires your approval and may cost extra.
Cleanup typically includes raking debris, blowing off sawdust, and hauling away branches and logs, unless the estimate says otherwise. Wood, logs, and wood chips may be left on site or removed as agreed.
Tree removal and tree cutting may be done by sectional rigging, by felling the tree in one piece, or by crane, depending on the site. We choose the method we judge safest for the job.
Stump grinding removes the stump to a depth of several inches below grade. Roots may remain and continue to decay. Ground material (wood chips and soil) is left in the hole unless removal is agreed. Stump removal involves digging out the stump and accessible roots, and some root material may remain.
Trimming and pruning are done using accepted arboricultural practices. Final shape and appearance involve professional judgment.
Satisfaction Guarantee
We stand behind our work. If you are not satisfied with the work described in your accepted estimate, tell us within 7 days after completion and give us the chance to inspect and make it right. This guarantee covers the quality of the work we performed. It does not cover the future health or stability of trees, and it does not extend to conditions described in the “Damage Claims and Limits on Our Responsibility” section below.
Payment
Payment terms are stated in your estimate or invoice. Unless otherwise agreed in writing, payment is due upon completion of the work.
We accept the payment methods (Card, Cash) listed on your invoice or estimate.
Late balances may be subject to a late fee or interest to the extent allowed by law, plus reasonable collection costs, including attorney fees, if we must pursue payment.
You are responsible for any returned-payment fees charged to us.
Cancellations
You may cancel a scheduled job at any time before work begins. Please give us at least 24 hours’ notice so we can reassign the crew. If we have already mobilized a crew or equipment (including a crane), or purchased materials for your job, we may charge a reasonable fee for time and costs incurred. If you are entitled to a cancellation period under state or federal law for your type of contract, that right applies and is not limited by this section.
Licensing and Insurance
We carry liability insurance for our work. Upon request, we can provide proof of insurance.
Damage Claims and Limits on Our Responsibility
If you believe our work caused damage to your property, tell us as soon as possible and no later than 7 days after the work is completed, and allow us to inspect before repairs are made. Prompt notice helps us resolve claims fairly and file with our insurer when appropriate.
We are responsible for damage caused by our negligence, subject to the limits below.
- We are not responsible for damage to hidden or unmarked items that you or the property owner did not disclose, such as underground lines, septic systems, or irrigation.
- We are not responsible for damage resulting from a tree’s pre-existing defects that could not reasonably be seen on inspection, or for trees, limbs, or stumps that fail later due to storms, disease, or decay.
- We are not responsible for minor surface marking from the lawful and careful use of heavy equipment, as described in the “Crane Service and Heavy Equipment” section.
- Trees are living things. We cannot guarantee the health, survival, or stability of any tree after trimming or of any tree near one we remove. We cannot guarantee that a tree will not fall or drop limbs in the future.
To the fullest extent permitted by law, our total liability for any claim arising from our services is limited to the amount you paid for the work in question, and we are not liable for indirect, incidental, or consequential damages, such as lost income or loss of use. Nothing in these Terms limits liability that cannot legally be limited.
Our Recommendations
Any recommendation to trim, remove, or retain a tree is a professional opinion based on what we can observe. If you decline our recommendation, you accept responsibility for the resulting risk.

Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, and costs arising from your providing inaccurate information about the property, trees, or ownership, your failure to disclose known hazards, or your instructing us to work on a tree or property you do not have authority to approve.
Governing Law and Disputes
These Terms are governed by the laws of the State of OKLAHOMA , without regard to conflict-of-law rules. We encourage you to contact us first so we can try to resolve any concern directly. If a dispute cannot be resolved informally, it will be handled in the courts located in Ponca City, OK, and you consent to their jurisdiction, unless the law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted, and the “Last Updated” date will be revised. Jobs already accepted are governed by the Terms in effect when you accepted the estimate, unless both parties agree otherwise in writing.

If any part of these Terms is found unenforceable, the rest remain in effect.
